    Basements are illegal for a reason usually there is a boiler room there that can give off carbon monoxide also nobody has mentioned that there is a illegal gas hookup in that apartment it should be no bathroom no kitchen in a basement that is the law turning a blind eye to these things is unlawful in the eyes of the city of New York and the laws that they’re supposed to protect people all those extra people on those blocks are overwhelming the sewer systems with sewers waste the sewer is in the streets are not designed for the extra people actually causes sewer backup not to mention the illegal plumbing that is in the basement you wrote a good story but the story should tell all the biggest thing is the illegal gas hookup and the boiler rooms in the basement that can give carbon monoxide poisoning and killing everyone possible landlords will not rent basements they are for storage only all the city looks at is having more people in the neighborhood that do not belong what do I mean that do not belong if a home can only fit 10 people you cannot put 20 people in their home

    Legalizing basement apartments is a very bad idea. Adding the required 2nd egress is always going to be an expensive process, and in older homes is not advisable. In fact adding the second egress can increase the likelihood of flooding because that second door will be below ground level.

    I live in a illegal basement home and it’s beautiful. I had no issues with flooding and the owner put sandbags around the home during the hurricane. Boiler has the proper ventilation, gas line is connected properly, and piping doesn’t leak. Rent is cheaper and I have a owner who has not raised the rent for 10 years.

      very rare… We live in a basement apartment of the sleaze ball owner (who lives above us) in East Elmhurst. Started out as month to month in 2019 (and he tried to raise the rent by $200.00 verbally (3 months after moving in) on a month to month lease because my mom was staying with me for awhile. This is where predatory aholes like him take advantage…they know you don’t want to move again and they want (illegal provision in the month to month saying only 1 person can live there) full control. I fought it (knowing he could legally raise it with a written notice) by contacting his broker and pointing out he was also responsible and to tell his client to back off citing Astoria v Chaves 1985. At the time (from Houston) I didn’t know the apt. was illegal which is probably why he backed off. 3 years later he had me sign a full year lease (because he said I was quiet and always paid rent on time. 2 days after signing, he came back and said he was giving me 5 months notice because his son got a new job near there and he would be moving in. Again, he did Not put it in writing and he can’t terminate a lease so family can move in. Now he is going after me in.a bizarre way (Queens Supreme Court) saying I am an illegal tenant who refuses to move. Blame all of this on the losers in the State Senate, City Council, DOB, HPD, etc., Why hell doesn’t DOB issue new COO’s when ownership changes. Why doesn’t HPD inspect multi family dwellings every 3 years or so to make sure nothing has changed? Why are basement/cellars all of the sudden so “vital”? Is it because corrupt pos like Cuomo, De Blasio, Hochul, Adams give preference to bloated, greedy developers? Fuck NY, truly a dark place.
