WageWorks, MTA Dispute Over Refunds for Unused Pre-Paid Commuter Benefits

The MTA actually made this Policy, not WageWorks. WageWorks will not provide credit to passes if the Agency does not Credit them back. MTA passes are good for 18 months after the print date. Meaning if the pass is unused, the person can swipe it when they DO go back to work and it’ll work as normal. The pass is not used for a specific month like New Jersey Transit passes are. If you buy a new car, can you return it anytime you want for a refund? Blame the Agency, not WageWorks.

BS… I have transit chek credit “cards” that are not MTA specific. They have expired and I was told they will not be replaced. Each is valued at over $200. According to WageWorks customer service the money from my cards has been turned over to the State. How do I make a claim? They are not specific to me but to my firm.

My situation is basically the same, $780 dollars of unused TransChek Credit, that I cant access as of March 2021. I use NJ Transit, not MTA. Why can’t they roll my money over into a new card? Governments cant just take your money, money doesn’t have an expiry date. Does anybody have advice on this? Thank you!

My experience, out of blue we received debit card for health benefits, BUT, we used it at the doctors office, shortly after got w.w. Letter stating we would have to pay back if verification is not returned to w.w. ! Why distribute qualified recipients debit cards and then demand repayment? Insane!

My card was funded for April and May. I have not used the MTA for all of April, and don’t plan on using it for all of May. June gets funded next week. So, if I cancel today, so that my card stops being funded, will I be able to use the April and May funds later this year by swiping my card to activate? Like, if in June I start going to my office again using the MTA, will I have those two 30-day periods worth of funds on my metro card that I can activate and use before I contact wageworks to uncancel and start my account funding again? That would be great to know.

I have two transit check cards that I used for commuting on the LIRR. I will no longer be commuting as I am considered high risk and will be moving out of state. I am unable to get in touch with a customer service representative to speak to @ 1.800.945.CHEK. $530 that I could have used for necessities during this pandemic. Refunds should be given to customers who have medical conditions where they cannot use the services with a doctor’s note.

I think the MTA should refund us. Especially since they are asking taxpayers for a bailout!!!
I did not meet the March 31st deadline because my company sent notice a day beforehand and my loved one was hit with COVID so that was the last thing on my mind. I would have expected my company to suspend all TransitChek deductions for its employees since everyone was told to work from home. I can’t believe they won’t even refund a hardship case. So now I’m out $500 that I really could use for survival.

The same thing is happening here to people working in Chicago. The date to change my transit order was the 8th of the month. I was on vacation during that week and returned to work on 3/16/20. On that day, I received an email from the railroad that I use telling me that because of Covid and realizing that people won’t be commuting as much, do not order the April ticket and you can use your March ticket for March and April. Well, little did I know that on 3/17/20, I was going to be furloughed. Well, needless to say, with the 16th and 17th of the month the only days I worked, after WageWorks took my money (I called them immediately on 3/16/20 about the email to not buy a ticket but they refused to do anything about it), I was left with a paycheck on 3/31/20 for $1.99. Yes, you heard me right — $1.99. Furlough lasted a month, I worked from home for two months, and now permanently laid off. Now my employer, who originally said they would help get my money back, says that they can’t give the money back because some law firm called The Wagner Group, or something like that, wrote something up over a year ago April, saying commuter benefits are not refundable. I say to that then, somebody stole my money — and who is it? WageWorks or my former employer? Forfeiture is not an option. That is my money that I earned and should be refunded. And everyone else should get their refunds also. Luckily for me I have 2 attorneys in my family — who will be hearing about this tomorrow.

Wageworks is stealing people’s hard earned money. In this pandemic situation we obviously cannot use our commuter cards, so they should have allowed flexibility on changes in the monthly deduction plan. Basically any change in plan is taking 2 months to be effective. I have 500 dollar in commuter card and I cannot use it now. And I might have to go back to my home country and they mentioned they will not refund the money. Wageworks customercare is a joke.

I too have 500 on a wage works card I’ve since moved to another state and am working from home and this money is sitting on a card when I should be able to use it for other purposes during this pandemic our financial situation is hard enough.

They got me for $127. Charged me for a card that was illegal to use in NYC. I notified them in March that I didn’t need the card for April. They still charged me and won’t refund the money, or give me a new card to use now that the trains are open again.

Ridiculous that they will not refund the money. The governer’s stay at home orders came too late to cancel. To make it better when I called wags works customer service I was told you can’t have more than 3 months of funds in the account anyway(already had 3 months at this point) . Guess what? They took a fourth!! Was finally able To stop deductions in time. This is highway robbery. This was an extraordinary situation – any prior agreements should not apply.

I am out almost $700….they won’t refund or allow me to use the card as a debit card. It must be for busses, rail, ferries… they suck big time! not my fault i was given strict orders to stay at home… they should have a backup plan to refund those that need the money.. They totally suck!!! here we are thinking were doing something good for ourselves with tax free money being used for commuting.. and in the end it hurt us.

I know what you are going through, the same thing is happen to me.
There must be a way to get our hard earn money back.
Why should we be penalize for what happen, when we need that money to help us to live?

I live in the Poconos and work for the MTA in NYC, My transit chek card has a $990 balance. Finally after weeks of indecision, being told you’ll reporting to work and then the plan being cancelled by MTA, I will be working from home until year end. Bottom line I will not have any use for transit chek, in addition I am retiring in January 2021. Contacted transit chek and told no refunds allowed, I ask what happens to the funds? answer “it goes back to your employer”. This was confirmed to me by the MTA administrator of the plan and is used to offset future administrative costs??? So my question WHY CAN’T I GET A REFUND? I have no pension and will live off social security, so do I need that money, you bet I do. We are being ripped off!

I pay monthly to park in a downtown parking garage in Columbus, Ohio. I contacted wage works and I was told by wage works to cancel my payroll deduction and to contact the parking garage. The funds are paid a month in advance. There was already a payment in process and that payment was returned to wage works. I find it frustrating and it seems to that is should be illegal to not refund funds to the payee after the employee has requested the payment to cease. I understand that for two months I did not cancel and I would not assume to have those payments returned, but for funds that were remitted after a request to cancel services seems illegal. Does anyone know if a Class Action Lawsuit has been started?

Same here, same story, no refunds but they will allow you to use it on Amtrak statewide, or travel in your local area. Wonderful, who is traveling? I have to stay at home to work due to a health concern. Why are they stealing our money? They can put it back to our checks to give us part of it, less the taxes. Sickening.

Wage Works sucks. My company gets the Transit Chek debit cards, which we didn’t distribute to people who were working remotely. The cards all have a January 2021 expiration date and Wage Works will not refund the cards. The only thing I can do is buy new cards ($21 minimum) and transfer balances. But many employees may never be coming back to the office.
Why couldn’t they make $1 cards if transferring balances is the only way to handle this?

Health Equity (which owns Wage Works) should be ashamed of themselves.

I’m out $267 bucks… I stopped deductions out of my paycheck as soon as possible… wageworks gave me the run around for months while I tried to get it back. They said ok we can refund NJ transit, and they did placing it back into wagework escrow. They mislead me and didn’t give it back. They said you have to get a wage works transit card to get reimbursed since the funds were stuck in their escrow. Then after I get their card they say no we can’t reimburse you, despite telling them… you told me to do this to get reimbursed. I even attempted to forfeit the funds back to trinet, because the supervisor at wageworks said it was a possible to do a forfeit. I opened up issue case numbers at wageworks and trinet for investigation. In the end wageworks blamed a pre-tax law and trinet specifically, that said they can’t reimburse the funds back to trinet. I feel robbed. All I could do was waste $267 bucks worth of their time and even more of my own. Wageworks and Trinets policies are disgusting… in the day and age of internet these terrible companies required 20 days advanced notice to lock a purchase for electronic transfers. Poor excuse to rob lots of people of money. I was 4 days late to stop the whole thing. Now I have a new job and will lose the money in 90 days. Wageworks told me to go sell and trade the card to someone. Sign me up for a class action lawsuit, I’m never using wageworks again or trinet if I can help it.

I buy for our company transitcheks. The company pays for the transitcheks and I would do a deduction in payroll each month. When COVID began and the Mayor of New York declared stay at home. To date, all employees that are part of this program have been staying home and working. I tried several times to return our transitcheks not for a refund but a credit on our account for the future. I have been denied that request and was reduce to buying the minimum amount $21.00 and told transfer the amounts. Now facing the prospect that once again most employees are still at home and stuck with the amount of almost $16,000.00 of unused funds. I have no pity for the Metro North since they are getting a bailout and the company I work for must take a loss. All I say is Karma is a b,,,,,,,,,,,!

so i read this trying to learn when the 5 monthly metro cards that i never swiped will begin expiring.

i called the MTA and they told me the cards are good for two years as long as they are not swiped. they can be mailed in for newer cards if they approach that 2 year limit.

they said they should be dated on them. i have not even opened the benefit envelops they arrived in.

Does anyone know what to do with transitchek that already expired? I have more than $500 in expired transitchek and Wageworks told me that it’s all gone and balance goes to the State unclaimed fund. Which department of New York State that we can reach out to get the refund?

I have 3 Transitcheks $127.00 each and they all expired a few weeks ago. Wage works won’t replace these cards. Due to covid they should refund or replacement cards should be offered . I am out almost $400.00. This Company should be shut down.

Fuck Wageworks, Fuck HealthEquity, fuck all these lying scamming, stealing motherfuckers. Claims denied for false reasons regularly, zero help from “customer service”, escalations ignored, resumbitions over 10 times. Countless hours wasted trying to get back my own money for amounts under $20. Absolute rubbish.
Legalized robbery. There should be a state or federal Attorney General looking into this immediately! Or at least a class action. Utter theft. FUCK WAGEWORKS!
